Torture Survivor filed an application at DAO, Banke for Compensation

Banke, 05 January 2016: Torture survivor Bablu alias Nijamuddhin Seikh has filed an application at District Administration Banke for compensation ordered by Appellate Court Nepalgunj.

As per the order of Appellate Courts of Banke to provide NPR 95,000/- to torture survivor Seikh, he had filed the application on 04 January 2016 at District Administration Office, Banke as per Section 9 of Compensation Relating to Torture Act, 2053. Registering the application Assistant Chief District Officer Jagat Bahadur Basnet said that his application will be forwarded for necessary action once the Chief District Officer resumes his office.

On 01 September 2015 a joint bench of Appellate Judges Yagya Prasad Basyal and Yamuna Bhattarai had decided to uphold the decision of District Court Banke issued on 02 June 2013 to order to provide NPR 95,000/- to torture survivor Seikh.

Though the District Court Banke had found that Seikh was severely tortured in the detention center of District Police Office, Banke, it had not ordered for full compensation to victim and departmental action against the perpetrators. So, the victim had filed an appeal on 16 January 2014 before the Appellate Court Banke demanding for full compensation and departmental action against the perpetrators. However, as the Appellate Court also upheld the decision of District Court victim Seikh said, "I am partly satisfied with the decision of the court because I still feel that I am not provided full justice." Likewise, his father Sattar Seikh said, "As the court didn't order for departmental action against the perpetrators, we feel that we are not provided full justice." They said that they should be provided compensation amount easily as per order of the court.

Claiming that he was tortured in the detention cell of District Police Office Banke, he had filed a case before District Court Banke on 06 September 2011 against DSP Dinesh Amatya and Constable Ashok Yadav.

Due to torture his lips were swollen, chest, mouth and legs were covered with blue marks and bruises and his L1 vertebra was cracked.
